4. Data collection on this website
Cookies
Our web pages use so-called “cookies”. Cookies are small data packets and do not cause any damage to your device. They are stored on your device either temporarily for the duration of a session (session cookies) or permanently (persistent cookies). Session cookies are deleted automatically at the end of your visit. Persistent cookies remain stored on your device until you delete them yourself or your web browser deletes them automatically.
Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them. Other cookies may be used to evaluate user behaviour or for advertising purposes.
These cookies are stored on the basis of Art. 6(1)(f) GDPR unless another legal basis is specified. The website operator has a legitimate interest in storing cookies for the technically error-free and optimised provision of its services. Where consent to the storage of cookies and comparable recognition technologies has been requested, processing is carried out exclusively on the basis of this consent (Art. 6(1)(a) GDPR and Section 25(1) TDDDG); consent can be revoked at any time.
Contact form
If you send us enquiries via the contact form, your details from the enquiry form, including the contact details you provide there, will be stored by us for the purpose of processing the enquiry and in case of follow-up questions. We do not pass on this data without your consent.
This data is processed on the basis of Art. 6(1)(b) GDPR if your enquiry is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of enquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if this has been requested.
The data you enter in the contact form remains with us until you request its erasure, revoke your consent to storage, or the purpose for storing the data no longer applies (e.g. after your enquiry has been processed). Mandatory statutory provisions – in particular retention periods – remain unaffected.
Vehicle inventory and enquiry forms (Autegro)
To display our vehicle inventory and for vehicle and selling enquiries, we use an embedded service provided by Autegro GmbH. When you open vehicle details or fill in an enquiry form, the data you enter is transmitted to Autegro and processed by us to handle your enquiry.
The Autegro widget is loaded directly from servers of Autegro GmbH when the relevant pages are opened (including the home page, vehicles and selling pages); your IP address may be transmitted to Autegro in the process. For a consistent display of fonts, the widget additionally loads so-called Google Fonts. In doing so, your browser establishes a connection to Google servers (Google Ireland Limited, Ireland; the transmission may also go to Google servers in the USA), whereby your IP address is transmitted to Google. We have no influence over this data transmission triggered by the embedded service.
The legal basis is Art. 6(1)(b) GDPR (pre-contractual measures) or Art. 6(1)(f) GDPR (legitimate interest in the efficient handling of vehicle enquiries and in a functional and appealing presentation of our vehicle offering). If you give your consent, processing is additionally based on Art. 6(1)(a) GDPR.
Further information on data protection at Autegro can be found at: https://app.autegro.de/datenschutz. Information on Google Fonts: https://developers.google.com/fonts/faq and in Google's privacy policy: https://policies.google.com/privacy. Our imprint can be found at /en/imprint.
Enquiries by email, phone or fax
If you contact us by email or phone, your enquiry, including all personal data resulting from it (name, enquiry), will be stored and processed by us for the purpose of handling your request.
Communication via WhatsApp
For communication with our customers and other third parties we use, among other things, the instant messaging service WhatsApp. The provider is WhatsApp Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland.
Communication takes place via end-to-end encryption (peer-to-peer), which prevents WhatsApp or other third parties from gaining access to the content of the communication. However, WhatsApp does gain access to metadata generated in the course of the communication (e.g. sender, recipient and time). We also point out that, according to its own statements, WhatsApp shares personal data of its users with its US-based parent company Meta. Further details on data processing can be found in WhatsApp's privacy policy at: https://www.whatsapp.com/legal/#privacy-policy.
WhatsApp is used on the basis of our legitimate interest in communicating as quickly and effectively as possible with customers, prospective customers and other business and contractual partners (Art. 6(1)(f) GDPR). Where corresponding consent has been requested, data processing is carried out exclusively on the basis of that consent; it can be revoked at any time with effect for the future.
The communication content exchanged between you and us on WhatsApp remains with us until you request its erasure, revoke your consent to storage, or the purpose for storing the data no longer applies (e.g. after your enquiry has been processed). Mandatory statutory provisions – in particular retention periods – remain unaffected.
The company is certified under the “EU-US Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the USA intended to ensure compliance with European data protection standards for data processing in the USA. Further information is available from the provider at the following link: https://www.dataprivacyframework.gov/participant/7735.
Data transfer to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://www.whatsapp.com/legal/business-data-transfer-addendum.
We have configured our WhatsApp accounts so that no automatic synchronisation with the address book on the smartphones in use takes place.
We have concluded a data processing agreement (DPA) with the above-mentioned provider.
5. Plugins and tools
Spam protection with ALTCHA (proof of work, no tracking)
To protect our contact form against abusive automated use (spam), we use the open-source method “ALTCHA”. Unlike classic CAPTCHAs (e.g. Google reCAPTCHA), ALTCHA analyses neither mouse movements nor behaviour and uses no cookies or external services.
When the form is submitted, your browser locally computes a cryptographic puzzle (“proof of work”), the solution of which is transmitted to our server and verified there. Only technical values of the puzzle (random string, result hash, expiry time) are processed — no personal characteristics and no biometric signals.
For each form request we temporarily store the sender's IP address (max. 10 minutes) to ensure rate-limited processing. This IP address is automatically discarded after the time window expires and is not processed further.
The legal basis for its use is Art. 6(1)(f) GDPR. We have a legitimate interest in protecting our contact form against automated abuse. No data is transmitted to Google, Cloudflare or other third-party providers — none at all.
Further technical information on ALTCHA can be found at altcha.org.
Google Maps (with consent)
On individual pages we embed map material from the “Google Maps” service. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland. The map is embedded only after your active consent via our consent banner (two-click solution). Until then, no content is loaded from Google servers and no connection to Google is established.
As soon as you load the map service, data (including your IP address) is transmitted to Google to display the maps and is usually stored on servers in the USA. We have no influence over the further processing of data by Google.
The legal basis for its use is your consent pursuant to Art. 6(1)(a) GDPR and Section 25(1) TDDDG. Consent can be revoked at any time via the consent settings.
You can withdraw your consent for Google Maps here: Revoke consent and show the consent banner again.
